A man who was refused service at a late-night shop tried to climb in through the hatch.

Blackburn Magistrates' Court heard when the assistant managed to close the window, Ryan Williams picked up a traffic cone and used it to cause £300 worth of damage.

Williams, 22, of no fixed address, pleaded guilty to criminal damage.

He was jailed for six weeks after the court was told he had been recalled to prison as he was on post-sentence supervision when the offence was committed.

Gareth Price, in mitigation, said his client had finished his last sentence in HMP Humber and on his release had been given an appointment at 2.30pm in Burnley that day.

“There was no train and he had to get a replacement bus,” said Mr Price.

“That meant he missed his appointment with probation and was immediately breached.”

He said his client spent a miserable few days living on the streets and had managed to borrow some money from a friend before going to the shop to buy some food.

Mr Price added: “He puts a different slant on the interaction between him and the shopkeeper, but the end result was the gentleman shut the hatch.

"He was frustrated because he was hungry and he had money to make purchases, but that doesn’t excuse his behaviour.”
