A JEALOUS man who threw a wine bottle at his partner was given a last chance by a judge.

Binge drinker Benjamin Fairburn, 30, and victim Amy Shaw had rowed and he had attacked her in bed. He then wrecked the Christmas tree and Ms Shaw set about him.

It ended with Fairburn flinging the bottle. It hit the victim in the face and smashed. 

She told police, who found her covered in blood: “He was going to kill me. He just went mental.”

Ms Shaw suffered two cuts, bruises and a scar to her left eyebrow, which she hid with makeup, Burnley Crown Court heard.

The hearing was told Fairburn, who had also taken ecstasy, had a record for domestic violence, had been on a programme, but didn't seem to have learned a lot.

Fairburn, formerly of The Castle, Colne, and now of Dickens Court, Blackburn, had admitted wounding. He was given 12 months in prison, suspended for two years, with 12 months supervision. The defendant must pay £1,000 compensation.

Stephen Parker, prosecuting, said trouble flared after the defendant and victim had been out last December 20.

After the attack, Ms Shaw was screaming and ran into the lounge. She rang the police and shouted: “Somebody come and help. He's going to kill me.”

The defendant was found hiding nearby. Fairburn had 19 offences on his record.

Kristian Cavanagh, for Fairburn, said he had shown remorse. He was jealous, controlling and misused alcohol and drugs, which had led to his offending.

He continued: “The defendant has voluntarily gone to his GP to see him about his abuse of drink and drugs.”

Sentencing, Judge Andrew Woolman told him: “You are good at saying you have learned your lesson, but when you have had too much to drink later on you forget all that and behave just as you did.”

The judge, who warned the defendant he was going to end up in jail if he didn't change, added: “I will give you one last chance. Most of your relationships collapse because of your jealous behaviour.”
