NORTH-WEST Euro-MP Paul Nuttall has criticised a European Court of Justice decision against a major organisation representing anti-windfarm groups.

The UKIP deputy leader said a ruling that the European Platform Against Windfarms does not have ‘legal personality’ and therefore no right to initiate a legal action was ‘disgraceful’.

It had tried to bring a case against the European Commission claiming its latest renewable energy targets failed to respect the rights of citizens to participate in environmental decision-making.

Mr Nuttall said: “This is a disgraceful judgement.

“In my view this judgment shows the contempt in which the European Union holds local protesters against windfarms.”

In this case, the European Court is following closely the position in English law.

In order for an organisation to take legal action in its own right, then it has to have legal personality - to be incorporated in some way. otherwise it is just a collection of individuals.

Why doesn't the European Platform Against Windfarms simply incorporate as, say, a Company Limited by Guarantee? Costs £40 - far less than taking a case to the European Court.
