A MAN has been jailed for four years after raping a woman who fell asleep after getting drunk at a house party, a court heard.

Andrew Murray, 23, of Morse Street, Burnley, was sentenced after pleading guilty to rape at Burnley Crown Court last month.

He was jailed this week.

The woman was raped twice at a house in Burnley on March 25 last year, the court was told.

After Murray raped the woman, she fell asleep and reported the attack to the police later through a third party.

During police questioning Murray who, the court heard, was of good character with no convictions, had maintained he was not responsible for the attack.

But police said they were able to use DNA evidence to link Murray to the offence.

She was raped twice during the night after she was put into a child's single bed in one of the bedrooms in the house.

The woman, who had been put to bed after she became drunk, did not report the attack straight away because she was concerned about the effect it would have.

After the case, DC Neil Swindells, of Burnley CID, who worked on the case, said: "This was a nasty attack on a vulnerable adult through drink and circumstances.

"She had been drinking and was not in charge of her faculties. She remembers some of what happened.

"She waited to report the attack because she was worried about her friend's reaction.

"Throughout the interviews Murray maintained that he was not responsible and we were able to connect him to the attack through forensic evidence."

Apart from the fact he denied it was him who was responsible, he would probably have walked free from the police station as it doesent sound like if he had said it was consentual sex there seems little the police could have done. Not condoning it but "After Murray raped the woman, she fell asleep" says heaps about her too.

Both parties are innocent, it is the drink that is the real culprit here.

But im surprised she went back to sleep having been raped.

And 4 years is not enough.

I can tell you from experience that women can go out and get drunk, can consent to sexual activity and can then afterwards think "oh no" and cry rape.

A friend of mine was accused of rape a few yrs ago. Totally innocent, but the girl involved had a bf and claimed rape when he found out.

Whilst no-one is denying the facts of the case, it would be entirely plausible to say she consented at the time but then in the harsh light of day the following morning saw it in a different light...

I have to agree with that comment,as I too know someone who was accused of 'sexual assault' in the same circumstances.
It was found that the female had got drunk,felt like a sh*g,but in the cold light of day,decided to accuse the said person of the assault,just in case she was pregnant(she had a husband,you see,and apparently,she was notorious for her little sexual 'faux pas'...)thus covering herself from any animosity from the said husband.
Fortunately,there was an officer involved who was aware of her reputation,and after a full investigation,she admitted that she had made up the entire story.

Having read the paper, sensationalism as is usual for this paper. Drink causes all kinds of problems, but in this case it seems that both parties are equalually to blaim! And the case as reported is typical of the cr*p written these days. I do feel sorry for the family involved, expecially the boy who has been sent to prison. Lets hope this girl does not try this again.
